Property

Section 72 Law of Property Act allows a partner to create a tenancy for himself and his partner or partners. Such a Partnership can so be created by intention of the Partners evidenced, and can be evidenced by a Partnership Agreement.

A partnership for joint lives is not a partnership at will (Moss v Elphik, Abbott v Abbott). Section 26 and 32 therefore do not have any application, and such a Partnership cannot be brought to an end by notice served by a Partner without the Agreement of the other Partner(s). Claimant was represented by our in house Solicitor Advocate. Mr. Seyi Ojo.

Dr. O. Ogunsanya-  Litigation Partner.
